By accessing or using SiteProof (“the Service”), operated via getsiteproof.ai, you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of these Terms, you may not access the Service. We reserve the right to refuse service to anyone for any reason at any time.
SiteProof provides automated website accessibility scanning and compliance monitoring tools based on the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. The Service uses the open-source axe-core testing engine to identify potential accessibility violations and provides remediation guidance.
Important disclaimers: (a) SiteProof is a technical scanning tool, not a legal service. Scan results do not constitute legal advice, certification, or a guarantee of compliance with any law, regulation, or standard, including but not limited to the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, the European Accessibility Act (EAA), or the Australian Disability Discrimination Act (DDA). (b) Automated scanning can detect approximately 30 to 40% of WCAG violations. Manual testing by accessibility professionals is recommended for comprehensive compliance. (c) A clean scan result does not mean your website is fully accessible or legally compliant. (d) You should consult qualified legal counsel for advice on your specific compliance obligations.
Certain features of the Service require account registration. When you register, you agree to: provide accurate, current, and complete information, maintain and promptly update your account information, maintain the security of your password and accept all risks of unauthorized access, notify us immediately of any unauthorized use of your account, and take responsibility for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
The free scanning tool is provided as-is with no guarantee of availability, accuracy, or completeness. Free scans are subject to rate limits (currently 5 scans per IP address per hour) and may be further restricted at any time. We reserve the right to modify, suspend, or discontinue the free scanner without notice. Free scan results may be less detailed than paid scan results.
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law (including Australian Consumer Law). We reserve the right to change pricing with 30 days notice to active subscribers. Failure to pay may result in suspension or termination of your account. You are responsible for all applicable taxes. Cancellation takes effect at the end of the current billing period.
You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to: scan websites you do not own or do not have explicit authorization to test; use the Service to attack, disrupt, or interfere with any website or server; attempt to circumvent rate limits, security measures, or access controls; use automated scripts, bots, or scrapers to access the Service beyond its intended interface; resell, sublicense, or redistribute scan results or reports without written permission; use the Service to compile data for competing products; submit malicious URLs designed to exploit the scanning infrastructure; impersonate any person or entity or misrepresent your affiliation; or use the Service in any way that violates applicable laws or regulations. Violation of these terms may result in immediate termination of your access without refund.
The Service, including its original content (excluding content provided by users), features, functionality, design, and underlying technology, is and will remain the exclusive property of SiteProof and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without prior written consent.
Scan results and reports generated for websites you own or are authorized to scan belong to you. You grant us a limited license to store and process the URLs and scan data you submit for the purpose of providing the Service. The axe-core scanning engine is open-source software licensed under the Mozilla Public License 2.0 and is maintained by Deque Systems, Inc.
You retain ownership of any data you provide to the Service. By submitting URLs for scanning, you represent that you have the right to scan those websites. We do not claim ownership of scanned website content. You are solely responsible for ensuring you have authorization to scan any URL you submit. We are not responsible for the content of scanned websites.
The Service may contain links to or integrate with third-party websites or services that are not owned or controlled by SiteProof. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that SiteProof shall not be liable for any damage or loss caused by the use of any such third-party services.
To the maximum extent permitted by applicable law, SiteProof and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation: loss of profits, data, use, goodwill, or other intangible losses; damages arising from missed accessibility violations or false negatives; damages resulting from incorrect or incomplete remediation suggestions; legal consequences, fines, penalties, or lawsuit costs arising from non-compliance; business interruption or loss of business opportunity; or any damages arising from your reliance on scan results.
Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred Australian dollars (AUD $100). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including Australian Consumer Law.
You agree to defend, indemnify, and hold harmless SiteProof and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: your use of the Service; your violation of these Terms; your violation of any third-party right, including intellectual property rights; your violation of any applicable law or regulation; or any content you submit to the Service, including URLs scanned.
We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to: modify or discontinue any part of the Service with or without notice; perform maintenance that may temporarily affect availability; update the scanning engine, which may affect scan results; and change features, functionality, or the user interface. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through mediation in Adelaide, Victoria, before proceeding to litigation. These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Victoria.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between you and SiteProof regarding the Service and supersede all prior agreements and understandings.
We reserve the right to modify or replace these Terms at any time. Material changes will be notified with at least 30 days notice via email or prominent notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the new terms, please stop using the Service.
